Effects of Tort Reform Legislation on Damage Claims and Lawsuits
Evidence from several of the studies suggests that different tort reform initiatives affect the number of lawsuits filed, the value of insurance claims, and the value of insurance payouts for damages. A 2001 study by Albert Yoon, for instance, found that the enactment of statutes to cap damages led to a significant reduction in the amount that plaintiffs recovered in medical malpractice lawsuits in Alabama relative to three neighboring states.
